Upgrades or Changes to Facility Design or Operation

Upgrades or changes to an authorized solar energy facility will be coordinated with the BLM and other appropriate agencies.

Operators of solar power facilities on BLM-administered lands shall coordinate with the BLM and other appropriate Federal, state, and local agencies regarding any planned upgrades or changes to the solar facility design or operation. Proposed changes of this nature may require additional environmental analysis and/or revision of the Plan of Development (POD).

For proposed projects, a change in technology type would require an amendment if deemed a substantial deviation in location or use (43 CFR 2807.20) and would likely require a reevaluation of the cost recovery agreement (43 CFR 2804.15).
