Reject Bids (if applicable)
The BLM may reject bids regardless of the amount offered.
- If the BLM rejects a bid, the BLM will notify the bidder in writing and the notice will include the reason(s) for the rejection and identify refunds to which the bidder is entitled.
- If the BLM rejects a bid, the bidder may appeal that decision.
The BLM may offer the lease to the next highest qualified bidder if the successful bidder does not execute the lease or is for any reason disqualified from holding the lease.
If the BLM is unable to determine the successful bidder, the BLM may re-offer the lands competitively. Also, if lands offered receive no bids, the BLM may:
- Re-offer the lands through the competitive process described at 43 CFR 2809.13; or
- Make the lands available through the non-competitive application process found in 43 CFR 2803, 2804, and 2805, if the BLM determines that doing so is in the public interest.
